Private College successfully defends small claims action for refund 20 June 2016
Abacus Legal is pleased to have successfully represented one of the cities largest Private Language Schools in the defence of an action in the small claims court for a refund of course fees following the expulsion of a student. The Court accepted that the college acted properly in its expulsion of the student for failing to meet the requirements of attendance. The Court attached significance to the effective communication of the terms and conditions for entry onto the course to the student in advance of his commencement of study. The submission and arguments by Abacus Legal identified to the Court's satisfaction that there was no merit to the Applicant's claim.

Department of Foreign Affairs Consular Apostille section to move on 22nd February 2016 19 February 2016

Interim List of Eligible Programmes (ILEP) finally published 20th January 2016 25 January 2016
The Irish Government has published the Interim List of Eligible Programmes (ILEP). The ILEP comprises list of approved Irish colleges authorised to provide courses of study to non EU/EEA students attending Ireland on a study visa. The process of application commenced in July 2015 and the date was moved to implementation on the 20th January last. The next update is scheduled for April 2016. Applications for the next update of the list for colleges wishing to enter courses close on the 4th February 2016. The list will be updated every three months.
Colleges on the list have had to pass a rigorous scrutiny by the Department of Justice/ILEP Administration section and to prove their ability to meet the standards required by the Department in the delivery of courses. Abacus Legal is pleased to have partnered a number of colleges in their application for transition to the list and is further pleased to announce a 100% successful transfer of its client colleges.

Capital Gains Tax (CGT) threshold for residential property increased 8 January 2016
The Irish Revenue Commissioners have increased the Capital Gains Tax (CGT) threshold from €500,000.00 to €1million under Section 42 of the Finance Act 2015 and which change came into effect on 1 January 2016. Residential sales below €1m will no longer have to seek capital gains tax clearance as part of the process of sale.
This increased threshold applies solely in respect of disposals of residential houses / apartments, The €500,000 threshold remains in place, as before, for disposals of all other Irish land and buildings (including commercial property), meaning sales of such properties for more than €500,000.00 are still subject to a pre-completion tax clearance application.
Interim List of Eligible Programmes (ILEP) to be introduced on the 20th January 2016 25 November 2015
The Irish Government today announced that the replacement register, the Interim List of Eligible Programmes (ILEP) for colleges in Ireland will be introduced on the 20th January 2016. The ILEP will be the definitive list of Irish colleges authorised to provide courses of study to non EU/EEA students attending Ireland on a study visa. It will replace the current Internationalisation Register (IR) on that date. Up to this date students from outside the EU/EEA are free to attend colleges on the IR and seek visas for the purposes of their study here.

Introduction of Interim List of Eligible Programmes postponed from 1st October 2015 16 September 2015
A circular from the Department of Justice released yesterday to English language education providers has advised that the Interim List of Eligible Programmes (ILEP) has now been postponed from the 1st October next when it was due to be introduced. The date for implementation is expected in the following weeks but is yet to be announced. College inspections are due to commence.
Application date for Private Colleges again extended to 31st July 2015 16 July 2015
The closing date for applications for Private Language Schools to transfer course to the Interim List of Eligible Programmes (ILEP) has now been extended a further time to the 31st July 2015. Colleges are urged to familiarise themselves with the guidelines in particular. The Department of Justice has warned that applications may be rejected for being incomplete.

Application date for Private Colleges extended to 20th July 2015 7 July 2015
The closing date for applications for Private Language Schools to transfer course to the Interim List of Eligible Programmes (ILEP) has been extended to the 20th July 2015. Colleges who wish to sell courses to Non EU/EEA students after the 1st October 2015 must have their courses listed on the ILEP by that time. Applications open for Private Colleges to transfer to Interim List of Eligible Programmes 16 June 2015
The Department of Justice has now issued the Applications form and Guidelines for foreign language schools to transfer courses currently on the Internationalisation Register to the newly introduced Interim List of Eligible programmes. The Application and guidelines are available on the Irish Naturalisation and Immigration Service website. Colleges are advised to get applications in before the 30th June 2015. This is the date advised as the deadline for submissions in the announcement on the 25th May last.
Summer break for Licensing dates in Dublin 16 June 2015
Festival season is upon us. The last of the available licensing dates in Dublin before the Summer break is the 29th July 2015. Applications must be filed in the Court office at least a week beforehand. It is advisable to make the licensing application for an earlier date (any Wednesday) so that any issues that arise can be dealt with by the Court before the Summer recess. Applications for late night exemptions must also be made in July to cover events in August and September.
The Licensing dates open up again in September. The annual renewal dates are as follows:
- Pub objections and confirmations - Thursday 24th September at 10.30 a.m.
- Clubs - Friday 25th September at 10.30 a.m.
- Music and singing - Friday 25th September at 2.00 p.m.
- General exemptions - Monday 28th September at 10.30 a.m.
- Restaurants - Monday 28th September at 11.00 a.m.
- Dance - Tuesday 29th September at 10.30 a.m.

Changes in Regulation in the English language sector in Ireland 25 May 2015
On the 25th of May 2015 the Irish Government announced the long awaited changes in regulation for English language schools to be introduced by the Departments of Justice and Education. The effect of these changes overall are to enhance the protections for students travelling from outside the EU to study in Ireland and also to ensure a more universal standard of operation amongst colleges in the sector. Some of the changes take effect from the 2nd June 2015. The remaining changes will be fully implemented by the 1st October 2015.

Changes to Company law in Ireland in 2015 13 May 2015
The long awaited changes in company law in Ireland are due to come into effect on the 1st June 2015. The new Companies Act 2014 broadly simplifies the law in relation to companies in Ireland but there are important changes to be aware of, especially in the field of director's duties and also the need to convert existing private limited companies to the newer form "CLS" or "DAC" type. Private Colleges Form New Organisation 30 January 2015
Following on the successful High Court action regarding changes in regulation for English language schools in the Ireland, the applicant colleges Academic Bridge and NED Training Centre have been involved in the formation a new organisation, the Private College Network, along with a number of colleges in Dublin and around Ireland that have felt the need for a new representative organisation.
The Private College Network has issued a press release calling on the Minister to act now to restore confidence in the Irish education market place and suggesting a five point plan to meet the need for changes in regulation balanced against the interests of the colleges in the sector and the accrediting bodies.

Mortgage Lending Regulations introduced for residential property buyers 27 January 2015
The Central Bank of Ireland today introduced new regulations concerning the issue of mortgages by banks and Building Societies for buying residential property in Ireland. In a move to try and prevent another overheating property market, especially in Dublin, the regulations were introduced reducing in some cases the limits in percentage terms that can be borrowed against the property's purchase price. Language Schools await the announcement by Minster for Justice 21 January 2015
Following the successful High Court challenge by Dublin language schools NED Training Centre and Academic Bridge, private language schools in Ireland are now awaiting the statement from the Minister for Justice Frances Fitzgerald T.D. The Minister had postponed the changes due to be implemented on the 1st January 2015 to today the 21st January. In a press release issued through the Minister's website on the 13th January Minister said that she would consider the effect of the judgment without any reference to postponed date of the 21st January. A statement is not yet forthcoming from the Minister. Updates will be posted on this site.
High Court overturns changes to Regulation of Foreign Language Schools 13 January 2015
In a preliminary ruling of the High Court today the Court struck down as unlawful the manner of implementation of changes introduced by the Minister for Finance on the 2nd September 2014. In a case taken by Abacus Legal on behalf of NED Training Centre and Academic Bridge a challenge was made to the late imposition by the Minister for Justice that only colleges with the ACELS accreditation could transfer their courses from the existing register, the Internationalisation Register onto the Interim List of Eligible Programs (ILEP). The High Court agreed that the manner for change adopted by the Minister was unlawful.

Capital Gains Tax relief on property not renewed for 2015 2nd December 2014
The relief from CGT in respect of the first seven years of ownership for properties purchased between 7 December 2011 and 31 December 2014 is not being extended beyond 31 December 2014. The Irish Revenue Commissioners have confirmed that the normal rule as to when an asset is acquired for CGT purposes (i.e. when an unconditional contract is signed) will apply for the purpose of the relief in section 604A TCA 1997.
The Relief was introduced to stimulate the investment property market in Ireland whereby anyone purchasing from late 2011 could dispose of the property after seven years without any liability to Irish Capital Gains tax. This will no longer be the case and CGT liabilities will be charged at (currently) 33% of the gain at time of sale.
